Preserving Indigenous Wisdom: Exploring Intellectual Property Rights of Tribal Communities in Kerala

This research endeavors to investigate the complexities surrounding the preservation and protection of indigenous wisdom among tribal communities in Kerala, India, with a specific focus on intellectual property rights (IPR). The objectives of this study are threefold: firstly, to examine the existing legal frameworks and policies pertaining to the recognition and protection of indigenous knowledge within Kerala's tribal communities; secondly, to analyze the cultural and socio-economic factors influencing the transmission and preservation of traditional knowledge systems; and thirdly, to assess the implications of IPR regimes on the safeguarding of indigenous wisdom and the empowerment of tribal communities. The methodology employed in this research is primarily qualitative, drawing upon a multi-disciplinary approach that integrates legal analysis, ethnographic research, and community engagement. Legal documents, policy reports, and scholarly literature will be reviewed to gain insights into the existing legal frameworks governing intellectual property rights and indigenous knowledge in Kerala. Additionally, fieldwork will be conducted in select tribal communities within Kerala to gather qualitative data through interviews, focus group discussions, and participant observation. The qualitative data will be analyzed thematically to identify patterns, themes, and implications related to the preservation and protection of indigenous wisdom. The findings of this research are expected to shed light on the challenges faced by tribal communities in Kerala in preserving their indigenous wisdom amidst rapid socio-economic changes and globalization. Moreover, the study aims to contribute to the ongoing discourse on indigenous knowledge and intellectual property rights by offering nuanced insights into the implications of existing legal frameworks and policies on the empowerment and autonomy of tribal communities. Ultimately, this research seeks to advocate for more inclusive and culturally sensitive approaches to intellectual property rights that respect and safeguard the rich heritage of indigenous wisdom in Kerala's tribal communities.
